Terms of Service

These Terms of Service ("Terms") govern your purchase and use of the BookyAI software and website, provided by HELIX MIND FZCO ("BookyAI", "we", "us"). By purchasing or using BookyAI, you agree to these Terms. If you do not agree, do not use the software or website.

1. License

Subject to these Terms and your chosen plan, we grant you a personal, non-exclusive, non-transferable license to install and use BookyAI:

• Annual plan: access for the duration of your paid subscription period.
• Lifetime plan: a one-time purchase granting ongoing access to the version line you purchased, including updates we make available to it.

You may not resell, sublicense, redistribute, rent, or share your license or the software, and you may not reverse-engineer or attempt to extract its source except as permitted by law.

2. Your content & responsibilities

You are responsible for the topics, inputs, and books you create with BookyAI, and for how you publish and sell them. You agree to:

• Comply with all laws and with the rules of any platform you publish to (including Amazon KDP), such as content and quality standards and any required disclosure of AI-assisted content.
• Ensure you have the rights to any material you input, and that your output does not infringe others' rights.
• Use your own third-party AI provider accounts and keys in accordance with those providers' terms.

3. No guarantee of outcomes

BookyAI is a tool that helps you create and format books. We do not guarantee that any book will be accepted, approved, or published by Amazon KDP or any other platform, and we do not guarantee any sales, income, or other results. Outcomes depend on your inputs, your decisions, your market, and the policies of third-party platforms.

4. Third-party services

BookyAI may integrate with third-party services (such as AI providers and payment processors). We are not responsible for those services, their availability, their pricing, or their terms, which you accept directly with them.

5. Intellectual property

The BookyAI software, website, branding, and related materials are owned by HELIX MIND FZCO and protected by law. These Terms do not transfer any ownership to you. Books you create with BookyAI are yours, subject to your responsibilities in Section 2.

6. Payment & refunds

Prices are shown at checkout. Annual plans renew unless cancelled before the renewal date. Purchases are covered by our Refund Policy.

7. Disclaimers

BookyAI is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, HELIX MIND FZCO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to BookyAI will not exceed the amount you paid us in the 12 months before the claim.

9. Termination

We may suspend or terminate your access if you breach these Terms or misuse the software. On termination, the license granted to you ends.

10. Governing law

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai, without regard to conflict-of-law rules. Disputes are subject to the competent courts of Dubai, UAE.

11. Changes

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the updated Terms.
